Terms of Service

These Terms govern your access to and use of JavaGrove's Java application hosting services, including our JVM containers, control panel, and related tools. By creating an account or using the Services, you agree to be bound by them.

01Overview

These Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and JavaGrove ("JavaGrove," "we," "us") governing your use of our Java-specific hosting platform, including JVM containers, runtime environments, staging tools, databases, and any dashboard or API we provide (collectively, the "Services"). By registering for an account, provisioning a container, or otherwise using the Services, you accept these Terms in full.

If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization, in which case "you" refers to that organization.

02Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent that you meet this requirement and that your use will not violate any law or regulation applicable to you, including export control and economic sanctions laws.

We may decline to provide the Services, or may suspend or terminate an account, where we reasonably believe doing so is necessary to comply with sanctions, anti-money-laundering, or other legal obligations.

03Your Account

You are responsible for maintaining accurate account information, safeguarding your login credentials, and for all activity that occurs under your account, whether or not you authorized it. Notify us promptly at hello@javagrove.net if you suspect unauthorized access.

You may grant limited, revocable access to your account to teammates or contractors, but you remain responsible for their actions and any obligations under these Terms.

04The Services

JavaGrove provides isolated JVM containers for deploying Java applications, with support for Tomcat, Jetty, GlassFish, Payara, WildFly, and TomEE runtimes depending on your plan. Specific resource allocations, container counts, and included features are described on our Plans page and vary between the Sapling, Grove, and Canopy tiers.

We may perform scheduled maintenance, security patching, or infrastructure changes that temporarily affect availability. Where practical, we'll provide advance notice of maintenance windows that are expected to cause downtime. Uptime commitments for paying customers are set out separately in our Service Level Agreement.

Features described as "beta," "preview," or "early access" are provided without the uptime or support commitments that apply to generally available Services, and may be changed or discontinued at any time.

05Acceptable Use

You agree not to use the Services to:

  • Host content or run applications that are illegal in the jurisdictions where JavaGrove operates or where your application is accessible;
  • Distribute malware, conduct denial-of-service attacks, or otherwise interfere with the integrity or performance of the Services or other customers' containers;
  • Send unsolicited bulk email or engage in activity that would cause our IP ranges to be blocklisted;
  • Infringe the intellectual property, privacy, or other rights of any third party;
  • Attempt to gain unauthorized access to another customer's container, our infrastructure, or any connected systems; or
  • Resell raw container capacity as a competing hosting service without our prior written consent.

We may investigate suspected violations and take action we consider appropriate, including removing content, throttling a container's resources, or suspending an account, as described in Section 10.

06Customer Content & Data

You retain all rights to the application code, data, and content you deploy to your JVM containers ("Customer Content"). You grant JavaGrove a limited license to host, cache, back up, and transmit Customer Content solely as necessary to provide the Services.

You are solely responsible for Customer Content and for ensuring you have the necessary rights and consents to host and process it, including any personal data of your own end users. Our handling of account and billing data about you is described in our Privacy Policy.

If we receive a valid legal request or a credible report that Customer Content is illegal or violates these Terms, we may remove or restrict access to it, and will notify you where legally permitted to do so.

07Fees & Billing

Fees for paid plans are billed in advance on a monthly or annual basis, as selected at signup, and are charged automatically to your payment method on file. Plans renew automatically at the end of each billing period unless canceled before the renewal date.

Prices are as listed on our Plans page at the time of purchase or renewal. We'll give advance notice before a price change takes effect on your account, and any change will apply starting with your next billing cycle.

Usage-based add-ons — such as additional JVM containers, extra storage, or overage on database connections — are billed in arrears based on actual usage during the billing period.

08Refunds

New annual subscriptions may be canceled for a full refund within 14 days of purchase. Monthly subscriptions are non-refundable once a billing period has begun, but you may cancel at any time to prevent future renewals; your Services will remain active through the end of the period you've already paid for.

Refunds are not available for partial billing periods, add-on usage already incurred, or accounts suspended for violation of these Terms.

09Service Changes, Maintenance & Discontinuation

We continually improve the Services and may add, modify, or remove features. Where a change is likely to materially reduce functionality you rely on, we'll provide at least 30 days' notice where reasonably possible, so you have time to adjust or migrate.

If we discontinue a runtime, plan tier, or the Services as a whole, we will provide reasonable advance notice and, where applicable, a pro-rated refund for prepaid periods you won't be able to use.

10Suspension & Termination

We may suspend or limit access to a container immediately, without prior notice, where we reasonably believe doing so is necessary to prevent harm to our infrastructure, other customers, or third parties — for example, in response to active abuse, a security incident, or non-payment.

For other violations of these Terms, we will generally provide notice and a reasonable opportunity to cure before suspending or terminating your account, except where the violation is severe or repeated.

You may terminate your account at any time from your dashboard. Upon termination, we may delete Customer Content and account data after a reasonable grace period, subject to any legal retention obligations described in our Privacy Policy.

11Third-Party Services

The Services may link to or integrate with third-party tools (for example, a domain registrar, a CI provider, or a payment processor). Your use of those tools is governed by their own terms, and JavaGrove is not responsible for their availability, content, or practices.

12Disclaimer of Warranties

Except as expressly set out in these Terms or in our Service Level Agreement, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

13Limitation of Liability

To the maximum extent permitted by law, JavaGrove will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.

Liability cap. JavaGrove's total aggregate liability arising out of or related to these Terms or the Services will not exceed the amount you paid to JavaGrove for the Services in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14Indemnification

You agree to indemnify and hold JavaGrove harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Customer Content, your violation of these Terms, or your violation of any applicable law or third-party right.

15Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which JavaGrove is incorporated, without regard to conflict-of-laws principles. Before filing a claim, both parties agree to attempt in good faith to resolve any dispute informally by contacting hello@javagrove.net. Disputes not resolved informally will be subject to the exclusive jurisdiction of the courts located where JavaGrove is incorporated, except where mandatory local consumer-protection law provides otherwise.

16Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services or for legal or operational reasons. We'll post the revised Terms on this page, and where a change is material, we'll provide additional notice — such as an email or dashboard notification — before it takes effect. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.

17General Provisions

  • Force majeure. Neither party is liable for delay or failure to perform caused by circumstances beyond its reasonable control.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Entire agreement. These Terms, together with our Privacy Policy and Service Level Agreement, constitute the entire agreement between you and JavaGrove regarding the Services.
